These Terms of Service (“Terms”) govern your access to and use of the Gozo Golf website, online store, customer account features, content, and related website services operated by Gozo Golf Inc. (“Gozo Golf,” “Gozo,” “we,” “us,” or “our”).

By accessing or using our website, creating an account, submitting information, or placing an order, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you must not use the website.

Our online store is hosted using Shopify, which provides the ecommerce platform that enables us to offer products and services online. Shopify is not the seller of Gozo Golf products unless expressly stated otherwise.

2. Eligibility and Age Requirements

You must have reached the legal age of majority in your province, state, country, or other jurisdiction to create an account, enter into a purchase contract, or place an order through the website.

A minor may use the website only under the supervision of a parent or legal guardian. The parent or legal guardian is responsible for the minor’s use of the website and compliance with these Terms.

  • Interfere with the website, its servers, Shopify services, payment systems, or another user’s access
  • Upload malicious code, viruses, malware, or other harmful materials
  • Use the website for fraud, unlawful activity, harassment, infringement, or deceptive conduct

Gozo Golf may investigate suspected violations and may restrict, suspend, or terminate access where reasonably necessary.

4. Customer Accounts

You may be permitted to create a customer account through the website.

You are responsible for:

  • Maintaining the confidentiality of your login credentials and password
  • Restricting access to your account and devices
  • All activities conducted through your account
  • Promptly updating your contact, billing, and shipping information

  • The user has violated these Terms or another applicable Gozo Golf policy

Account suspension or termination does not eliminate payment or other obligations arising before the suspension or termination.

5. Product Information

We make reasonable efforts to provide accurate product descriptions, specifications, images, videos, prices, availability information, and other content.

However:

  • Product colours may appear differently depending on lighting, photography, display settings, and manufacturing variations
  • Product dimensions and weights may be rounded or subject to reasonable measurement tolerances
  • Battery range, runtime, charging time, speed, operating distance, and performance figures are estimates and may vary
  • Actual performance may depend on terrain, incline, load, weather, temperature, battery condition, operating mode, maintenance, user behaviour, wireless conditions, and other factors
  • Product appearance, packaging, components, software, firmware, features, or specifications may be updated or improved over time
  • Images and videos may include optional accessories, prototypes, pre-production products, or environments not included with the purchased product

Reasonable variations that do not materially affect the product’s intended function do not automatically constitute a defect or misrepresentation.

Product use is also subject to the applicable user manual, safety instructions, warnings, maintenance guidance, and warranty terms.

6. Prices, Promotions, and Currency

Product prices, promotions, discounts, bundles, coupon codes, and availability may be changed or withdrawn at any time before an order is accepted.

A price change does not affect an order that Gozo Golf has already accepted, except where the displayed price resulted from an obvious error, technical malfunction, unauthorized discount, or other material mistake.

Prices may be displayed in different currencies depending on the customer’s market, location, website settings, or checkout selection.

Unless expressly stated otherwise:

  • Canadian prices are generally displayed in Canadian dollars
  • United States prices are generally displayed in US dollars
  • Taxes, shipping charges, duties, tariffs, brokerage fees, and other applicable charges may be added at checkout or handled as described in the applicable policy
  • Exchange rates and currency-conversion charges may be determined by Shopify, the payment provider, card issuer, bank, or other third party

Promotions and discount codes:

  • May have specific eligibility, geographic, product, account, or time restrictions
  • May not be combined unless expressly permitted
  • May be modified, suspended, or withdrawn before use
  • Have no cash value unless required by law
  • May be cancelled if obtained or used through fraud, manipulation, duplication, or technical error
  • Promotional offers, affiliate links, creator codes, ambassador codes, referral codes, and partner discounts may be subject to separate campaign-specific terms.

7. Orders and Contract Formation

Submitting an order does not guarantee that the order has been accepted.

After an order is placed, you may receive an automated order confirmation. This confirmation acknowledges receipt of the order but does not necessarily constitute final acceptance.

Gozo Golf may review an order for product availability, payment authorization, shipping eligibility, pricing accuracy, fraud risk, purchase limits, and other reasonable commercial or legal considerations.

An order is generally accepted when Gozo Golf confirms acceptance, begins fulfillment, or ships the order, subject to applicable law.

Gozo Golf reserves the right to refuse, limit, hold, or cancel an order for reasons including:

  • Product unavailability
  • Incorrect product, pricing, promotional, tax, or shipping information
  • Payment failure or authorization issues
  • Suspected fraud, identity theft, misuse, or unauthorized activity
  • Unusually large quantities or suspected unauthorized resale
  • Violation of purchase limits
  • An inaccurate, incomplete, or undeliverable address
  • Carrier, geographic, lithium-battery, export, customs, or legal restrictions
  • Website, inventory, payment, or technical errors
  • Violation of these Terms or another applicable Gozo Golf policy

If Gozo Golf cancels an order after payment has been collected, Gozo Golf will refund the amount collected for the cancelled portion to the original payment method, unless another method is agreed or required by law.

Bank, credit-card, and payment-provider processing times may affect when the refunded amount appears.

8. Pre-orders and Backorders

Products identified as pre-order, backorder, made-to-order, or temporarily unavailable may have different estimated processing or shipping dates. Any estimated date is not guaranteed unless required by law.

Gozo Golf will disclose the expected timing before purchase where reasonably available and will notify the customer of material delays. Customers may request cancellation before shipment, subject to applicable law and any clearly disclosed product-specific terms.

9. Obvious Errors

Gozo Golf may correct obvious typographical, pricing, promotional, product-description, inventory, tax, shipping, currency, or technical errors.

If a material error is discovered before shipment, Gozo Golf may:

  • Correct the information
  • Contact you to confirm whether you wish to proceed under the corrected terms
  • Cancel the affected product or order
  • Refund any payment collected for the cancelled portion

Gozo Golf will not knowingly fulfill an order at an obviously incorrect price caused by a technical, data-entry, system, or display error where applicable law permits correction or cancellation.

Nothing in this section limits rights available under mandatory consumer-protection law.

10. Payment

Payment methods available through the website may include credit or debit cards, Shopify Payments, Shop Pay, PayPal, installment-payment providers, electronic transfer, or other methods displayed at checkout.

Available payment methods may vary by location, currency, product, transaction value, and provider eligibility.

An order may be delayed, held, limited, or cancelled if payment cannot be verified or authorized.

Installment services and third-party payment arrangements are subject to the provider’s separate terms, eligibility requirements, fees, credit decisions, and privacy practices. Gozo Golf does not control a third-party provider’s approval decision or account terms.

11. Taxes, Duties, and Import Charges

Applicable sales taxes may be calculated based on the products ordered, customer location, delivery address, transaction details, and applicable tax rules.

International or cross-border orders may be subject to:

  • Tariffs
  • Customs charges
  • Brokerage fees
  • Local taxes
  • Carrier processing fees
  • Other governmental or delivery charges

Responsibility for these charges is governed by the information shown at checkout and Gozo Golf’s Shipping Policy.

Customers are responsible for providing accurate information needed for tax, customs, and delivery processing.

12. Shipping and Delivery

Order processing, shipping eligibility, free-shipping offers, carrier selection, estimated delivery times, remote-area charges, tracking, address changes, missed deliveries, refused deliveries, damage claims, and shipping restrictions are governed by the current Shipping Policy.

Delivery estimates are not guaranteed unless expressly stated otherwise or required by applicable law.

Title, responsibility, and risk relating to a shipment will be determined in accordance with applicable law, the selected delivery arrangement, and the Shipping Policy.

Customers must monitor tracking information and make reasonable arrangements to receive high-value, oversized, or signature-required shipments.

13. Returns, Refunds, Exchanges, and Cancellations

Returns, refunds, exchanges, order cancellations, product-condition requirements, restocking or refurbishment deductions, damaged-on-arrival claims, and non-defective return-shipping costs are governed by the current Return & Refund Policy.

You must obtain written return instructions and, where applicable, return authorization before sending a product back.

Unauthorized or improperly shipped returns may be refused, delayed, or subject to additional charges, as permitted by law.

Eligible Gozo Golf products may be covered by the current Limited Warranty Policy.

A commercial warranty does not replace or reduce any mandatory legal guarantee or consumer remedy that applies in the customer’s jurisdiction.

15. Product Safety Notices and Recalls

Gozo Golf may issue product safety notices, service campaigns, mandatory firmware updates, repair instructions, stop-use notices, or recalls where reasonably necessary. Customers are responsible for maintaining current contact information and following safety instructions associated with their product. Nothing in this section limits any obligation Gozo Golf has under applicable product-safety law.

16. Policies Incorporated into These Terms

The following policies are incorporated into and form part of these Terms where applicable:

If these Terms conflict with a specific policy concerning a matter addressed by that policy, the specific policy will govern that particular matter.

For example:

Mandatory applicable law will prevail over any conflicting contractual provision.

This section does not require a consumer to indemnify Gozo Golf for Gozo Golf’s own negligence, breach, unlawful conduct, or responsibility that cannot legally be transferred to the consumer.

27. Governing Law and Jurisdiction

These Terms are generally governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Subject to mandatory applicable law, disputes arising from these Terms or the website may be brought before the courts located in Ontario, Canada.

However:

  • Consumers in other Canadian provinces or territories retain any non-waivable rights and remedies available under local law
  • Consumers in the United States retain any mandatory rights available under applicable federal or state law
  • Consumers in the European Union, European Economic Area, United Kingdom, or another jurisdiction retain any mandatory local consumer rights, remedies, and jurisdictional protections

Nothing in these Terms requires a consumer to waive a legal right, remedy, forum, or protection that cannot lawfully be waived.

Gozo Golf will not be responsible for delay or failure caused by circumstances outside its reasonable control, except where applicable law provides otherwise.

  • Labour disputes
  • Carrier or customs disruptions

Gozo Golf will make reasonable efforts to communicate material delays and perform affected obligations when reasonably possible.

  • Shopify or third-party services
  • Security requirements
  • Applicable laws or regulations

The remaining provisions will continue in effect.

32. No Waiver

A failure or delay by Gozo Golf in enforcing a provision of these Terms does not waive the right to enforce that provision or another provision later.

Any waiver must be express and applies only to the specific matter for which it is given.

33. Assignment

You may not assign or transfer your rights or obligations under these Terms without Gozo Golf’s prior written consent, except where applicable law provides otherwise.

Gozo Golf may assign these Terms in connection with a merger, reorganization, financing, sale of assets, or transfer of the business, provided that doing so does not reduce mandatory consumer rights.

34. Entire Agreement

These Terms, together with the incorporated policies and any product-specific or order-specific terms presented before purchase, constitute the agreement between you and Gozo Golf concerning use of the website and purchases made through it.

They replace prior website terms concerning the same subject matter.
